Abstract
ABSTRAK Dengan adanya pandemi Corona Virus Disease 2019 (Covid-19) saat ini yang pertama kali diumumkan sebagai pandemi global pada 11 Maret 2020 lalu oleh World Health Organization (WHO) yang kemunculan pertama kali di Wuhan, Tiongkok membuat pertumbuhan dan perkembangan kehidupan berbangsa dan bernegara di Indonesia tidak sedikit membawa persoalan, tantangan, dan bahkan ancaman yang terhitung relatif cukup besar dan komplek. Pemerintah menanggapi keadaan ini sebagai hal ikhwal kegentingan yang memaksa berdasarkan pernyataan WHO dengan menetapkan adanya regulasi untuk mengatur stabilitas keuangan negara yang terdampak akibat pandemi. Pengaturan tersebut dituangkan dalam Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2020 Tentang Kebijakan Keuangan Negara dan Stabilitas Sistem Keuangan Untuk Penanganan Pandemi Corona Virus Disease 2019 dan/atau Dalam Rangka Menghadapi Ancaman Yang Membahayakan Perekonomian Nasional dan/atau Stabilitas Sistem Keuangan yang selanjutnya diterapkan menjadi Undang-Undang Nomor 2 Tahun 2020 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2020 Tentang Kebijakan Keuangan Negara dan Stabilitas Sistem Keuangan Untuk Penanganan Pandemi Corona Virus Disease 2019 dan/atau Dalam Rangka Menghadapi Ancaman Yang Membahayakan Perekonomian Nasional dan/atau Stabilitas Sistem Keuangan. Penetapan PERPPU tersebut ditetapkan sebagai instrument yuridis dalam penanganan covid-19 karena telah terbukti memberi dampak antara lain terhadap perlambatan pertumbuhan ekonomi nasional, penurunan penerimaan negara, dan peningkatan belanja negara dan pembiayaan. Oleh karena itu, diperlukan upaya pemerintah untuk melakukan penyelematan kesehatan dan perekonomian nasional. Presiden beralasan adanya penyebaran Covid-19 bukan hanya ada pada masalah kesehatan, tetapi juga masalah kemanusiaan yang berdampak pada aspek sosial, ekonomi, dan mempengaruhi fundamental perekonomian nasional. Oleh karena itu, dibutuhkan landasan hukum agar pemerintah dan otoritas terkait dapat mengambil langkah-langkah yang bersifat luar biasa (extraordinary actions) secara cepat dan tetap akuntabel untuk penanganan Pandemi Covid-19 bila diperlukan. ABSTRACT With the current Corona Virus Disease 2019 (Covid-19) pandemic which was first announced as a global pandemic on March 11, 2020 by the World Health Organization (WHO), which first appeared in Wuhan, China made the growth and development of the life of the nation and state in Indonesia brings many problems, challenges, and even threats that are relatively large and complex. The government responded to this situation as a matter of urgency that forced the WHO statement by establishing regulations to regulate the financial stability of countries affected by the pandemic. The regulation is stated in Government Regulation in Lieu of Law Number 1 of 2020 concerning State Financial Policy and Financial System Stability for Handling the 2019 Corona Virus Disease Pandemic and/or In Facing Threats That Endanger the National Economy and/or Financial System Stability, which is then implemented Law Number 2 of 2020 concerning Stipulation of Government Regulation in Lieu of Law Number 1 of 2020 concerning State Financial Policy and Financial System Stability for Handling the 2019 Corona Virus Disease Pandemic and/or in Facing Threats That Endanger the National Economy and/or System Stability Finance. The determination of the PERPPU is designated as a juridical instrument in handling COVID-19 because it has been proven to have an impact, among others, on the slowdown of national economic growth, a decrease in state revenues, and an increase in state spending and financing. Therefore, government efforts are needed to save health and the national economy. The President reasoned that the spread of Covid-19 is not only a health problem, but also a humanitarian problem that has an impact on social, economic aspects, and affects the fundamentals of the national economy. Therefore, a legal basis is needed so that the government and relevant authorities can take extraordinary actions (extraordinary actions) quickly and remain accountable for handling the Covid-19 pandemic if needed.
