Abstrak

Berkendara menggunakan sepeda motor merupakan hak semua orang, termasuk para penyandang disabilitas. Oleh sebab itu, pihak kepolisian saat ini tengah mempromosikan lagi pembuatan surat izin mengemudi (SIM) D khusus untuk masyarakat penyandang disabilitas. Dalam Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan (LLAJ) Pasal 80 tentang bentuk dan penggolongan SIM, penyandang disabilitas diperbolehkan mengendarai sepeda motor khusus di jalan raya asalkan mengantongi SIM D. Peruntukan SIM D untuk penyandang disabilitas diatur dalam Peraturan Kapolri Nomor 9 Tahun 2012 Tentang Surat Ijin Mengemudi. Lain dengan SIM A dan C yang berbeda peruntukan sesuai jenis kendaraannya, SIM D khusus teman-teman Disabilitas dapat dipergunakan baik untuk sepeda motor maupun mobil. Adapun sejumlah persyaratan yang harus dipenuhi dalam mengurus pembuata SIM D, diantaranya penyandang disabilitas harus memiliki sertifikat kesehatan dari dokter. Bagi disabilitas tuli, harus menggunakan alat bantu dengar. Sedangkan, untuk disabilitas daksa, mereka harus membawa motor yang sudah dimodifikasi sesuai kebutuhan penyandang disabilitas Daksa. Menjadi permasalahan menarik karena tidak ada ketentuan lebih lanjut yang mengatur bagaimana prosedural pelayanan pengurusan SIM bagi disabiltas, sehingga perlu untuk dikaji lebih lanjut.

Abstrac

Riding a motorbike is the right of everyone, including people with disabilities. Therefore, the police are currently promoting the issuance of a driving license (SIM) D specifically for people with disabilities. In Law Number 22 of 2009 concerning Road Traffic and Transportation (LLAJ) Article 80 concerning the form and classification of SIMs, persons with disabilities are allowed to ride a special motorcycle on the road as long as they have SIM D. Number 9 of 2012 concerning Driver's License. Unlike SIM A and C, which differ according to the type of vehicle, SIM D specifically for friends with disabilities can be used for both motorbikes and cars. There are a number of requirements that must be met in taking care of making a SIM D, including persons with disabilities must have a health certificate from a doctor. For those who are deaf, they must use a hearing aid. Meanwhile, for people with disabilities, they must bring a motorbike that has been modified according to the needs of people with disabilities. It is an interesting problem because there are no further provisions that regulate how procedural SIM management services are for people with disabilities, so it needs to be studied further.
