Banking law system on the basis of syariah principles (Islamic Law) with profit sharing system, enables to apply in Indonesia after the prevailing of the Act number 7, 1992 about Banking (article 6 letter in). This act was followed by the implementation stipulation in The Government Regulation number 72, 1992. It is hoped that this act can give contribution, creating carefulness, and harmony for banks and customers and can perform effectively and efficiently. The problems discussed in this thesis are ; What are the principles of profit sharing in financing, How is ' the application of financing on the basis of profit sharing principles on the customers of PT. Bank BNI Syariah Jember, and What are the juridical obstructions and the settlements faced by PT. Bank BNI Syariah Jember in applying profit sharing principles in financing customers. The approach method done in the research is Socio Legal research. Socio Legal research is used as social medication therefore law is applicated on its surface. In socio legal research, law is always meant to be social problem. The research focus on individual behavior or community related to the law. The approach method conducted in this research was judicial normative by the research on positive law collection, the research on legal principles, law systematic, vertical and horizontal synchronizations, the history of law, and legal comparison. PLS Financing selume also has the weakness in it’s performing espscially in connection with the nigh risk including financing risk, market risk, and operasional risk.
