Penelitian ini bertujuan menganalisis urgensi pengkajian ulang regulasi Pergantian Antar Waktu (PAW) anggota
legislatif untuk memperkuat perlindungan hak konstitusional calon terpilih dan menjaga integritas demokrasi
perwakilan. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan,
konseptual, dan studi kasus. Hasil penelitian menunjukkan adanya ketidakharmonisan antara UU Pemilu, UU
Partai Politik, UU MD3, dan peraturan KPU yang membuka celah bagi partai politik untuk mengganti calon
terpilih secara sepihak dengan alasan pelanggaran AD/ART partai, tanpa prosedur yang transparan dan
akuntabel. Praktik ini berpotensi menegasikan prinsip suara terbanyak, mencederai kedaulatan rakyat, dan
menimbulkan ketidakpastian hukum. Kasus Achmad Ghufron Sirodj memperlihatkan lemahnya mekanisme
perlindungan hukum bagi calon terpilih, khususnya terkait kewenangan Mahkamah Partai dan pengawasan
KPU. Simpulan penelitian ini menegaskan perlunya reformulasi regulasi PAW dengan menitikberatkan pada
due process of law, keadilan substantif, dan perlindungan suara rakyat. Rekomendasi meliputi penguatan peran
Mahkamah Partai, harmonisasi peraturan antar lembaga, dan pembatasan kewenangan partai dalam PAW
untuk mencegah penyalahgunaan kekuasaan serta memastikan pergantian anggota legislatif selaras dengan
prinsip demokrasi dan supremasi hukum.

Abstract
This study aims to analyse the urgency of reviewing the regulations on the replacement of legislative members
during their term of office (PAW) in order to strengthen the protection of the constitutional rights of elected
candidates and maintain the integritybof representative democracy. The method used is normative juridical with
a legislative, conceptual, and case study approach. The resultsbof the study show that there is a lack of harmony
between the Election Law, the Political Party Law, the MD3 Law, and KPUnregulations, which opens up
loopholes for political parties to unilaterally replace elected candidates on the grounds of violations of
partynstatutes, without transparent and accountable procedures. This practice has the potential to negate the
principle of majority rule,nundermine the sovereignty of the people, and create legal uncertainty. The case of
Achmad Ghufron Sirodj highlights the weakness ofnlegal protection mechanisms for elected candidates,
particularly regarding the authority of the Party Court and KPU oversight. Thenfindings of this st udy
underscore the need to reformulate PAW regulations with a focus on due process of law, substantive justice,
andnprotection of the people's voice. Recommendations include strengthening the role of the Party Court,
harmonising regulations betweenninstitutions, and limiting the authority of parties in PAW to prevent abuse of
power and ensure the replacement of legislative members aligns with democratic principles and the supremacy
of law.
