Abstract
Abstrak Perkawinan poligami atau beristri lebih dari 1 (satu) dalam Undang-Undang Perkawinan juga diperbolehkan, namun demikian dengan beberapa persyaratan yang wajib dipenuhi. Namun demikian, dalam praktiknya banyak terjadi perkawinan poligami yang tidak sesuai dengan prosedur, yaitu tanpa seijin isteri pertama dengan melakukan nikah di bawah tangan (nikah siri) dengan wanita lain. Berdasarkan hal tersebut timbul permasalahan bagaimanakah perlindungan hukum terhadap istri sah atau isteri pertama, khususnya menyangkut adanya harta bersama dalam perkawinan karena adanya harta bersama suami dan istri dari perkawinan pertama berikut dampaknya terhadap pembagian terhadap istri pertama maupun istri keduanya. Terkait izin atau persetujuan oleh istri diatur lebik spesifik dalam Peraturan Pemerintah Nomor 9 Tahun 1975 menyatakan bahwa izin harus dibuat secara hitam diatas putih Abstrac Polygamous marriages or wives of more than 1 (one) in the Marriage Law are also allowed, however, with several conditions that must be met. However, in practice there are many polygamous marriages that are not in accordance with the procedure, that is, without the permission of the first wife, by carrying out an underhand marriage (siri marriage) with another woman. Based on this, the problem arises how the legal protection of the legal wife or the first wife, especially regarding the existence of joint assets in marriage because of the joint assets of husband and wife from the first marriage and the impact on the distribution of the first wife and the second wife. Regarding permission or approval by the wife, it is regulated more specifically in Government Regulation Number 9 of 1975 which states that permits must be made in black and white.
