Karimata No.49 Jember 68121 Email : www.unmuhjember.ac.id Abstrak Selain pembagian harta melalui pewarisan, pembagian harta dapat dilakukan lalui hibah. Hibah merupakan salah satu tuntunan dari ajaran agama Islam yang menyangkut kehidupan bermasyarakat dalam rangka ibadah ijtima (ibadah sosial). Karena hibah merupakan salah satu bentuk aplikasi ibadah, maka tujuan utamanya adalah pengabdian kepada Allah dan ikhlas karena mencari ridho-Nya. Dalam penerapannya, pelaksanaan hibah dalam masyarakat dapat menggunaka atau petunjuk tentang bagaimana hibah tersebut dapat diterapkan, dan acuan terpat dalaKompilasi Hukum Islam (KHI) dan juga dalam Kitab Undang- Undang Hukum Perdata dengan beberapa pasal yang mengatur tentang hibah itu sendiri. Terkait pelaksanaan hibah, adakalanya menimbulkan sengketa karena adanya beberapa pihak yang tidak setuju dengan hibah tersebut, sehingga harus diselesaikan melalui mekanisme di Pengadilan. Kata Kunci : Pembatalan Hibah, Tanah, Harta Bersama Abstract In addition to the distribution of assets through inheritance, the distribution of property can be done through grants. Grants are one of the guidelines of the teachings of Islam that concern community life in the context of ijtima worship (social worship). Because grants are one form of worship application, the main purpose is devotion to God and sincerity for seeking His blessing. In its implementation, the implementation of grants in the community can use references or instructions on how the grant can be applied, and references are contained in the Compilation of Islamic Law (KHI) and also in the Civil Code with several articles governing the grant itself. Related to the implementation of the grant, sometimes it causes disputes because there are some parties who do not agree with the grant, so it must be resolved through a mechanism in the Court Keywords : Revocation of Grants, Natural Father, Child, Heir
