Abstract

ABSTRAK Gagasan metode sederhana dalam pembentukan perutaruran perundang undangan yakni omnibus law telah disahkan dengan berlakunya Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja, hal ini yang melatar belakangi penelitian ini karena pembentukan peraturan perundang-undangan di Indonesia masih mengacu pada Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan dimana dalam Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan masih belum mengaturnya maka terjadi kekosongan hukum, metode yang digunakan guna memecahkan permasalahan tersebut ialah yuridis-normatif, hasil dan pembahasan penelitian ini ialah gagasan metode omnibus law memang belum dinormakan dalam Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan namun mengenai kedudukan hukum Undang-Undang dengan metode penyusunan omnibus law, kedudukannya sama dengan Undang-Undang dibawah UUD NRI 1945 dan Tap-MPR. Kata Kunci: Omnibus Law, Pembentukan Peraturan Perundang-Undangan, Kekosongan Hukum. ABSTRACT The idea of a simple method in the formation of statutory regulations, namely the omnibus law has been passed with the enactment of Law Number 11 of 2020 concerning Job Creation, this is the background of this research because the formation of laws and regulations in Indonesia still refers to Law Number 12 of the Year 2011 Regarding the Formation of Laws and Regulations where in Law Number 12 of 2011 concerning the Formation of Laws and Regulations still not regulating it, there is a legal vacuum, the method used to solve these problems is juridical-normative, the results and discussion of this research is the idea of a method. The omnibus law has not been normalized in Law Number 12 of 2011 concerning the Formation of Legislative Regulations but regarding the legal position of the Law with the omnibus law drafting method, its position is the same as the Law under the 1945 Constitution of the Republic of Indonesia and the MPR Decree.
