Abstark
Penelitian ini bertujuan untuk menganalisis bagaimana wewenang serta tanggung jawab Pemerintah Daerah
Kabupaten Jember dalam menangani masalah terkait kasus Prostitusi Gay yang praktiknya semakin terlihat di Kabupaten
Jember dengan berdasarkan ketentuan yang ada di Undang - Undang Nomor 23 Tahun 2014 Tentang Pemerintahan
Daerah. Sehingga peneliti tertarik untuk melakukan penelitian ini. Peneliti menggunakan jenis penelitian yuridis
normative dengan metode pendekatan menggunakan peraturan perundangan dan konseptual. Adapun hasil dari
penelitian ini yakni tanggung jawab Pemerintah Kabupaten Jember dalam menangani masalah prostitusi gay selama ini
hanya terbatas pada upaya pencegahan HIV/AIDS. Hingga saat ini, belum terdapat Peraturan Daerah (Perda) maupun
Peraturan Kepala Daerah (Perkada) yang secara tegas dan khusus mengatur tata kelola, pencegahan, serta
penanggulangan prostitusi gay di wilayahnya. Padahal, prostitusi gay termasuk kategori bencana non-alam yang
berdampak serius, seperti timbulnya korban jiwa serta gangguan psikologis dan mental pada pelakunya. Kondisi ini
menunjukkan adanya kekosongan regulasi yang berpotensi menghambat efektivitas penanganan masalah tersebut

Absract
This study aims to analyze the authority and responsibility of the Jember
Regency Government in addressing issues related to gay prostitution, a practice that is
increasingly prevalent in Jember Regency, based on the provisions of Law Number 23 of
2014 concerning Regional Government. Therefore, the researcher is interested in
conducting this research. The researcher used a normative juridical research type with an
approach method utilizing statutory regulations and conceptual. The results of this study
indicate that the Jember Regency Government's responsibility in addressing gay
prostitution has so far been limited to efforts to combat HIV/AIDS. To date, there is no
Regional Regulation (Perda) or Regional Head Regulation (Perkada) that expressly and
specifically regulates the management, prevention, and handling of gay prostitution in
the region. In fact, gay prostitution is categorized as a non-natural disaster with serious
impacts, such as loss of life and psychological and mental disorders in perpetrators. This
condition indicates a regulatory vacuum that has the potential to hinder the effective
handling of this problem.
