Abstract

ABSTRAK Indonesia merupakan negara hukum, dimana konstitusi merupakan modal hukum tertinggi untuk dijadikan sebagai pedoman dalam pengambilaan keputusan untuk mengatasi permasalahan yang muncul. Oleh sebab itu setiap kegiatan baik yang dilakukan masyarakat maupun pejabat apabila melanggar konstitusi akan berlaku sebuah sanksi terhadapnya. Baru-baru ini telah terjadi bencana pandemi penyebaran virus corona diseluruh negara, tidak terkecuali Indonesia, yang berakibat pada terganggunya sistem kestabilan keuangan nasional. Untuk itu pemerintah yang ditunjuk sebagai penggerak roda pemerintahan membentuk sebuah aturan untuk menjaga kestabilan perekonomian nasional negara yakni yang tertuang dalam Undang-undang nomor 2 Tahun 2020 tentang Penetepan Pemerintah Pengganti Undang-undang Nomor 1 Tahun 2020 tentang Kebijakan Keuangan Negara dan Stabilitas Sistem Keuangan untuk Penanganan Pandemi Corona Virus Disease 2019 (Covid-19) dan/atau Dalam Rangka Menghadapi Ancaman yang Membahayakan Perekonomian Nasional dan/atau Stabilitas Sistem Keuangan. Akan tetapi terjadi polemik dalam materi muatan yang terkandung didalmnya dimana hal ini menagkibatkan timbulnya sebuah akibat hukum yang kemudian melahirkan hubungan hukum yang baru dimana hal ini bertentangan dengan konstitusi negara, yaitu Undang-undang Dasar 1945. Dalam konteksnya pembentukan peraturan ini dibentuk karena keadaan darurat namun tidak dibenarkan apabila materi muatan yang terkandung dalam sebuah peraturan yang hierarkinya berada dibawah Undang-undang Dasar bertentangan atau bahkan melebihi materi muatan yang ada pada konstitusi. ABSTRACT Indonesia is a state of law, where the constitution is the highest legal capital to be used as a guide in making decisions to overcome problems that arise. Therefore, every activity, whether carried out by the public or officials, if it violates the constitution, will apply a sanction against it. Recently, there has been a catastrophic pandemic of the spread of the corona virus throughout the country, including Indonesia, which resulted in the disruption of the national financial stability system. For this reason, the government appointed as the driving force of the government has formed a rule to maintain the stability of the country's national economy, which is stated in Law No. 2 of 2020 concerning Stipulation of Government in Lieu of Law No. 1 of 2020 concerning State Financial Policy and Financial System Stability for Handlingpandemic Corona Virus Disease2019 (Covid-19) and / or in the Framework Facing Threat Endangering National Economy and / or the Financial System Stability. However, there was a polemic in the content contained in it where this resulted in the emergence of a legal consequence which then gave birth to a new legal relationship where this was contrary to the state constitution, namely the 1945 Constitution. it is not justified if the content material contained in a regulation whose hierarchy is under the Constitution contradicts or even exceeds the content material contained in the constitution.
