Abstract
ABSTRAK Tempat Pemakaman merupakan kebutuhan manusia yang tidak dapat dipisahkan sebagai makhluk yang fana (tidak kekal). Pemakaman tentunya memerlukan tanah yang dijadikan sebagai area persemaian terakhir yang diatur pelaksanaannya oleh pemerintah menurut Undang-Undang yang berlaku. Namun, didalam pelaksanaannya tentunya tidak secara penuh berjalan dengan baik, karena kebutuhan akan tanah yang semakin tinggi berbanding terbalik dengan ketersediaan tanah yang semakin berkurang. Sehingga pemerintah harus mengelola dengan baik ketersediaan yang ada terutama terhadap tempat pengelolaan pemakaman umum. Penelitian ini menggunakan metode penelitian hukum normatif yang bertujuan untuk memeriksa secara mendalam permasalahan hukum dengan cara menganalisisnya. Didalam penelitian ini juga menggunakan pendekatan undang – undang serta pendekatan konseptual dalam pendekatannya terhadap sumber dan bahan hukum yang kemudian direlevansikan terhadap permasalahan. Hasil daripada penelitian ini adalah menunjukkan ada atau tidak adanya pertanggung jawaban pemerintah terhadap penyediaan area lahan untuk pemakaman umum yang menjadi permasalahan yang terus mengalami perkembangan terutama dalam permasalahan yang erat kaitannya dengan tanah, pengadaan tanah, serta tanggung jawab pemerintah akan ketersediaan lahan pemakaman umum di Indonesia. ABSTRACT A burial place is an inseparable human need as a mortal (not eternal) creature. Burials of course require land to be used as the final seeding area, which is regulated by the government according to the applicable law. However, in its implementation it certainly did not go completely well, because the demand for land was increasing in inverse proportion to the decreasing availability of land. So the government must properly manage the existing availability, especially of places for managing public cemeteries. This research uses normative legal research methods which aim to examine legal problems in depth by analyzing them. This research also uses a legal approach and a conceptual approach in its approach to legal sources and materials which are then relevant to the problem. The results of this research show whether or not there is government responsibility for the provision of land areas for public cemeteries, which is a problem that continues to develop, especially in issues closely related to land, land procurement, as well as the government's responsibility for the availability of public burial plots in Indonesia.
