Abstract

Abstrak: Pilkada adalah salah satu mekanisme penting yang menunjukkan komitmen Indonesia terhadap prinsip-prinsip demokrasi, Aparatur Sipil Negara (ASN) sebagai pelaksana birokrasi pemerintahan dituntut untuk memiliki netralitas dan integritas dalam menghadapi proses demokrasi. Namun, setiap kali pemilu diselenggarakan, selalu diwarnai dengan maraknya pemberitaan mengenai pelanggaran imparsialitas yang dilakukan oleh oknum Aparatur Sipil Negara. Riset ini bertujuan untuk mengetahui bagaimana netralitas Aparatur Sipil Negara dalam pilkada serta untuk mengetahui bagaimana strategi yang tepat untuk meminimalisir terjadinya pelanggaran netralitas oleh Aparatur Sipil Negara. Riset ini menggunakan metode pendekatan peraturan perundang-undangan serta pendekatan konseptual dengan tipe yuridis normatif. Berdasarkan hasil riset ini, ditemui pelanggaran netralitas yang dilakukan oleh Asosiasi Pemerintah Desa Kabupaten Jember yang menyatakan secara jelas mendukung atas majunya Muhammad Fawaid sebagai calon Bupati dalam Pilkada 2024, tentu hal ini melanggar Pasal 280, 282, dan 490 UU Pemilu, oleh sebab itu strategi yang harus dilakukan untuk mencegah terjadinya pelanggaran netralitas tersebut, maka hendaknya Komisi Aparatur Sipil Negara sebagai pihak yang memiliki tanggung jawab serta responsif atas pengawasan pelaksanaan norma-norma sesuai regulasi, kode etik, serta kode perilaku ASN, menindak secara tegas Asosiasi Kepala Desa Jember yang secara jelas menyatakan dukungan kepada salah satu paslon yang akan maju dalam kontestasi pilkada. The State Civil Apparatus (ASN) as the implementer of government bureaucracy is required to have neutrality and integrity in facing the democratic process. However, every time a General Election activity takes place, it is always colored by widespread news about violations of neutrality by elements of the State Civil Service. This research aims to find out how neutral the State Civil Apparatus is in regional elections and to find out what the appropriate strategy is to minimize violations of neutrality by the State Civil Apparatus. This research uses a statutory regulatory approach and a conceptual approach with a normative juridical type. Based on the results of this research, a violation of neutrality was found by the Jember Regency Village Government Association which stated that it clearly supports the advancement of Muhammad Fawaid as a candidate for Regent in the 2024 Regional Elections, of course this violates Articles 280, 282 and 490 of the Election Law, therefore the strategy What must be done to prevent violations of neutrality, the State Civil Service Commission, as the party responsible for supervising the implementation of ASN norms, codes of ethics and codes of conduct, should take firm action against the Association of Jember Village Heads who clearly expressed support for one of the candidate pairs. who will advance in the regional election contestation.
