Abstract

This study discusses the legality of PT Bumi Suksesindo's gold mining business activities in using the function of protected forest areas. Its protected forest is very important for the balance of the surrounding ecosystem. But in reality protected forests in the village of Sumberagung, Pesanggaran sub-district, Banyuwangi Regency were used as mining areas under the pretext of transferring the function of the protected forest to permanent production forests. This study aims to determine the strength / legal position of the use of the function of protected forests for mining activities managed by PT Bumi Suksesindo in Sumberagung Village, Pesanggaran Sub-District, Banyuwangi Regency. The type of research used is perspective research, namely research that aims to describe or formulate problems according to existing conditions or facts. The results of the study show that mining business activities carried out by PT Bumi Suksesindo are illegal because the use of IPPKH is in the formerly used production forest area from the transition of protected forest through Decree 826 / Menhut-II / 2013 concerning Changes in Functions between Main Functions ofProtected Forests into Forests Fixed Production, which should still be used for production forests which cannot be used by the mining area because production forests are still only allowed to be harvested above the earth, not in the soil. This cannot be done because the permanent production forest from protected forest is very fertile, and the IPPKH should be available only in convertible production forests.
