Abstract

Backgroud : A riverbank is a space between the edge of a riverbed and the inside foot
of an embankment located on the left and / or right of the riverbed. The number of
river banks is used as a means to carry out the business and land use process for the
construction of buildings or shop houses conducted by entrepreneurs. Banyuwangi
regency government policy in protecting the Functions of Riverbanks namely
Banyuwangi Regency Regulation Number 11 of 2014 concerning Public Order and
Peace in the Banyuwangi Regency has been regulated in article 23 states that each
person or body Establishes buildings in the road border, beach border, river border ,
border railroad and green open space. Objective : To find out the Banyuwangi
Regency Government's Policy in Protecting the Function of Riverbanks. Method : In
this study, the authors use several approaches, the statutory approach or also called
the Statute approach and the method of sociological juridical approach, namely the
problem approach that is carried out by examining and reviewing legally the
enactment of legislation and legal norms in society. Results : in accordance with the
research that I have done in the field, the application of the policy of the authorized
agency, namely the Irrigation Service at the research location, according to the
author, is appropriate, but with time the lack of supervision from the competent
authority has passed. The actual implementation of the policy in the field is not in
accordance with or violates the regulations set by the Banyuwangi government in
Banyuwangi District Regulation Number 8 of 2012 concerning the Spatial Planningof the Banyuwangi Regency for 2012-2023, Article 94 paragraph (7), and Regency
Regulations Banyuwangi Number 11 of 2014 concerning Public Order and Peace in
the Community in Banyuwangi Regency, Article 23. Conclusion : The Irrigation
Service has issued a policy to protect the function of riverbanks, but many people
violate the policy. The government should be firm in controlling the buildings that
stand without meeting administrative and technical requirements. The community
should obey the policies issued by the irrigation service instead of constructing
buildings along the riverbank that damage the river's function and also the riverbank.
