Abstract

The occurrence of dual land title certificates over a single parcel represents
a significant issue in land administration, as it has the potential to weaken legal
certainty within the land registration system. This study seeks to examine the form
of administrative legal accountability of land officials in relation to the issuance of
overlapping certificates, with a specific focus on the Puskesmas Mangli property
in Jember Regency. The research adopts a normative juridical approach, utilizing
both statutory and conceptual analyses by reviewing applicable legal provisions
governing administrative governance and land affairs. The findings indicate that
the duplication of certificates resulted from insufficient verification of both
physical and juridical data during the land registration process, particularly in
relation to the assessment of land history and cadastral documentation. From the
perspective of administrative law, a land certificate qualifies as a state
administrative decision, which must comply with the essential elements of
authority, procedure, and substance. Where these elements are not satisfied, the
decision may be deemed invalid and subject to administrative remedies.
Furthermore, the study concludes that the administrative responsibility arising
from the issuance of overlapping certificates predominantly falls under official
liability, as the certificates were issued by officials acting within their formal
authority. This responsibility can be implemented through administrative
measures such as annulment, revocation, or correction of the flawed certificate by
the National Land Agency. Such measures illustrate the application of the
principle that administrative bodies possess the authority to withdraw their own decisions when administrative defects are identified. Overall, the study
underscores the necessity of enhancing verification mechanisms and strengthening
administrative oversight in the land registration process in order to uphold legal
certainty and prevent the recurrence of similar disputes in the future.
